EIP Litigation specialises in high value and complex patent litigation and patent prosecution matters across the UK, Germany and the Unified Patent Court (UPC). Using a team comprising solicitors, German Rechtsanwälte and patent attorneys enables EIP to handle all aspects of litigation strategy in-house, including the most complex patent amendment issues, across all technical fields. It also enables EIP to ‘road test’ cases to a level that we consider exceeds that available from many firms in the market.
The strength of the team can be seen from the complexity of the disputes in which it has been involved and the results achieved for clients. In the UK, these include litigation involving Google, Samsung, Huawei, Apple and Microsoft, as well as representation in the Supreme Court in Tesla v Avanci and Optis v Apple. This means EIP has acted in all three SEP/FRAND matters heard by the UK Supreme Court, including Unwired Planet v Huawei and Conversant v Huawei.
In Germany, the team has developed a strong track record in multinational patent litigation before both the German national courts and the UPC, leveraging its close integration with EIP’s patent attorneys. The German practice is particularly strong in electronics disputes and frequently advises on FRAND issues and licensing programmes. Recent matters have included litigation for MediaTek against Huawei, Datang against Xiaomi, Asus against Oppo, Asus against Xiaomi, Labrador Diagnostics against bioMérieux, Curio Bioscience against 10x Genomics, and Evolved against Samsung.
Operating as one integrated disputes practice across the UK and Germany, EIP is uniquely placed to coordinate multi-jurisdictional patent litigation strategies, providing clients with technically informed, commercially focused advice before national courts and the UPC.
